Terms of Use

TowerOlympus
Effective date: [EFFECTIVE DATE]

These Terms of Use ("Terms") apply to the TowerOlympus game ("the game") provided by [LEGAL NAME] ("we", "us"). They supplement Apple's Licensed Application End User License Agreement ("Apple EULA"), which also applies to your use of the game. If these Terms and the Apple EULA conflict, the Apple EULA wins.

By downloading or playing the game you agree to these Terms. If you do not agree, please do not use the game.

1. Who can play

Anyone can play. If you are under the age of majority where you live, a parent or guardian should review these Terms with you and is responsible for purchases made on your device. Parents can use Apple's Screen Time and Ask to Buy to control purchases.

2. Your licence

We give you a personal, non-exclusive, non-transferable, revocable licence to use the game on Apple devices you own or control, as allowed by the Apple EULA and the App Store's Usage Rules. You may not copy, modify, sell, rent or reverse-engineer the game or its content, except where the law allows it.

3. Ambrosia and other in-game items

  • Ambrosia is an in-game reward you earn only by playing. It cannot be bought.
  • Ambrosia, unlocked towers, cosmetic items and any other virtual items are a licence to use content inside the game. You do not own them.
  • They have no cash value. They cannot be exchanged for real money, goods or services, and cannot be sold, traded or transferred, inside or outside the game.
  • We may change, rebalance or remove virtual items (for example, to fix the game balance). We will not remove an item you paid for without a refund or an item of similar value, unless the law allows it or you broke these Terms.
  • Your progress and items are stored on your device. If you delete the game or lose your device without a backup, they cannot be recovered. Items you paid for can always be restored (see §4).

4. Purchases

  • All purchases are made through the App Store and are subject to Apple's Media Services Terms and Conditions. Apple processes the payment; we never see your payment details.
  • Prices are shown in the App Store before you confirm. Taxes are handled by Apple.
  • Refunds are handled by Apple, not by us. You can request one at reportaproblem.apple.com. If Apple refunds a purchase, the item is removed from the game.
  • Restore Purchases: permanent purchases (such as cosmetics, towers or the Supporter pack) can be restored at no cost on any device signed in with the same Apple Account, from Settings > Restore Purchases in the game.
  • Family Sharing: where shown on the App Store, permanent purchases can be shared with members of your Apple Family Sharing group. Consumable items cannot be shared. If someone leaves the family group, shared items are removed from their device.
  • Nothing in the game is a random-reward ("loot box") purchase. You always see exactly what you get before you buy.
  • Your statutory consumer rights are not affected.

5. Acceptable use

You agree not to:

  • cheat, use bots, modify the game or exploit bugs to gain an advantage, and you agree to report serious bugs to us;
  • interfere with other players' enjoyment of the game;
  • use the game for anything illegal.

Player names

Your player name must not:

  • contain profanity, slurs, sexual content, or hateful, racist or harassing language;
  • impersonate another person, a public figure, our team, Apple or any other company;
  • contain personal information (yours or anyone else's), links, email addresses or advertising.

We filter names automatically and may change or reset a name that breaks these rules without notice.

6. Ending your use

You can stop using the game at any time by deleting it. We may suspend or end your access to features if you seriously or repeatedly break these Terms. Where we can, we will tell you why. If we stop offering the game, the Apple EULA and the law decide what happens to items you paid for.

7. Changes to the game and to these Terms

We update the game to fix bugs and add content, and some features may change or be removed. We may update these Terms; we will post the new version here with a new effective date and, for significant changes, tell you in the game. If you keep playing after a change, the new Terms apply.

8. Our content

The game, its name, logo, art, music and code belong to us or our licensors. Greek myths are public domain; our versions of them are not.

9. Disclaimers

We work hard to keep the game bug-free, but it is provided "as is" and "as available". To the extent the law allows, we do not promise that it will always be available or error-free. Some countries do not allow these exclusions, so they may not apply to you.

10. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential losses, or for loss of in-game progress that you have not paid for. Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by negligence, fraud, or your mandatory consumer rights.

11. Governing law

These Terms are governed by the laws of [GOVERNING LAW]. Disputes go to the courts of [COURTS]. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring claims in your local courts.

12. Apple

  • These Terms are between you and us, not Apple. Apple is not responsible for the game or its content.
  • We, not Apple, are responsible for maintenance and support of the game.
  • If the game fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the game (if any). To the maximum extent the law allows, Apple has no other warranty obligation for the game.
  • We, not Apple, are responsible for any claims relating to the game, including product liability, legal or regulatory compliance, and consumer protection claims.
  • If a third party claims the game infringes their intellectual property, we, not Apple, are responsible for handling that claim.
  • You confirm that you are not in a country subject to a US Government embargo or on a US Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
